A new bill currently under second committee review — AB 2374 — would expand the requirements and timeframe for displaced janitors during a change in contractor. Under the current parameters for displaced janitors, employees who were on-site at a facility prior to a change in subcontractor or contractor were required to be retained for a minimum of 60 days (assuming they were meeting the requirements of their job).
This new bill, however, would expand that timeframe to 90 days, as reported by Calmatters. Additionally, the bill would require continued employment opportunities for the janitors previously on-site if the 90 day period is completed up to work satisfaction standards — an offer that would also be shared with any unions representing the employees.
Additional changes proposed include requiring a successor contractor to maintain the same wages and working hours for previously-hired janitors on the worksite. Additionally, awarding authorities for contractors must provide a written notification within five days for both a contractor and representing union if a service contract is set to be terminated.
Any instances in which these requirements aren’t met would open the opportunity for displaced employees to seek legal action with support from the Labor Commissioner. Read more on the details of the bill under review here.
